Waterside Properties reserves the right to refuse a property listing if it is not considered suitable for inclusion on their website www.watersideproperties.com. Waterside Properties’ decision to decline a particular property is final and no correspondence will be entered into.

Waterside Properties reserves the right to suggest amendments to how a property has been described and represented by the seller (either through its description, its pictures or stated location). If the seller of a property does not accept these suggestions and, in the opinion of Waterside Properties, the manner in which the property is portrayed is considered to be misleading, untrue or unfair, then we reserve the right to withdraw the property from the website; in such instances, no refund of the listing fee will be offered.
The seller is responsible for ensuring that the details submitted in respect of his or her home constitute a fair and reasonable representation and comply with relevant legislation concerning the sale and marketing of property.
With effect from 6 April 2012, sellers of residential properties placing their home on the market in England & Wales are required to produce an Energy Performance Certificate (EPC), and make it available to prospective purchasers from the time marketing of the property commences. It is be the seller’s responsibility to ensure that they have an EPC in place and must submit it to Waterside Properties in pdf format at the time of sending us the photographs and description of your property.
The seller is responsible for ensuring that he or she is not in breach of any existing estate agency agreement (such as sole agency or sole selling rights) that they may already have in place.
Subject to the above terms and conditions, upon receipt of the agreed listing fee and submission to the website, Waterside Properties Direct undertake to include the property on the website until it is either sold or withdrawn.

The nature of the agreement between Waterside Properties and the seller:
We may transfer all rights and obligations under this Agreement in circumstances where the seller’s rights under this Agreement are not materially affected.
The seller may transfer all rights and obligations under this Agreement to another person who has the legal right to sell the property following the completion of a new Agreement.
This Agreement supersedes all previous Agreements between the parties in respect of the property and may not be modified except in writing signed by both parties.
If any provision of this Agreement is held by any court or other competent authority to be void or unenforceable in whole or in part, this Agreement shall continue to be valid as to the other provisions and the remainder of the affected provision.
This Agreement shall be governed by and construed in all respects in accordance with the laws of England and Wales and each party hereby submits to the exclusive jurisdiction of the courts of England and Wales.
